[...] Bei der Nutzung der XOVI API ist der Nutzer zu folgendem Verhalten verpflichtet: Der Nutzer ist nicht verpflichtet, die Nutzung der XOVI API für Dritte kenntlich zu machen, es sei denn es handelt sich um einen Anbieter einer SAAS Lösung, der die abgerufenen Daten gegen Entgelt weiter veräußert. Das Unterlizensieren oder Verkaufen der XOVI API ist somit für diese Art der Anbieter ausdrücklich untersagt, wenn dies nicht im Einzelfall schriftlich vereinbart wurde. Solche Maßnahmen, die eine gebündelte und nicht für eine normale Nutzung notwendigen Traffic zufolge haben, einen überdurchschnittlichen Download verursachen und somit die Stabilität der XOVI Server beeinträchtigen, sind ausdrücklich untersagt. Die Nutzung der XOVI API für den Betrieb oder die Bewerbung von gesetzeswidrigen Internetseiten sind ausdrücklich untersagt. [...] Die Nutzung ist ferner untersagt für den Vertrieb von Anwendungen oder den Betrieb einer Seite, die in direkter Konkurrenz mit den Produkten und Dienstleistungen der XOVI GmbH steht.
