[...] Customer shall not resell, lease, rent, transfer, sublicense, or otherwise transfer rights to the Services. Customer shall not use Kickbox to perform competitive analysis. [...] Customer hereby agrees and warrants that Customer and Customer's authorized users will not engage in, encourage, enable, or permit: Using the Services for purposes directly or indirectly relating to the sending of unsolicited bulk commercial email ("Spam") of any kind, Using the Services to verify email address(es) obtained from a third party or obtained indirectly without the recipients' knowledge and consent, Using the Services to verify email address(es) of anyone who has not opted-in, or who has opted-out, of receiving email communications from Customer, Using the Services to harvest email addresses or otherwise determine the existence of unknown email addresses [...] Committing or attempting to commit a crime or facilitate the commission of any crime or other illegal or tortious act, or using the Services for any activity or conduct that is or is likely to be in breach of any applicable laws, codes or regulations, including data protection and privacy laws and laws relating to unsolicited commercial electronic messages [...] Acceptable Use Policy: To use our Service, you must agree to verify only permission-based email addresses. This means all recipients must have opted-in to receive communications from the verifying entity. [...] Purchased lists may not be used with the Service, regardless of the source or permission status. [...] You may not use Kickbox's Service to: verify harvested email addresses from websites or other sources, verify purchased lists (whether they are opt-in or not), verify permutations of email addresses, also known as directory harvesting, verify email addresses generated via email appending, verify email addresses without the subscriber's permission to receive email communications from your entity [...] If you use the Services to verify email addresses obtained in any way other than a subscriber opting-in to your list, you may incur a $100 (US) charge per substantiated incident (i.e. per verification) |
